§ 1. Definitions

Working days - days from Monday to Friday, except public holidays.

Account - a free Store function (a service provided electronically) regulated by separate regulations, thanks to which the Buyer can set up his individual Account in the Store.

Consumer - a consumer within the meaning of the provisions of the Civil Code.

Buyer - any Buyer in the Store.

Regulations - these regulations.

Store - online store - distributor of BabyBlanca brand products, run by the Seller at https://www.babyblanca.pl.

Seller - BabyBlanca, an entrepreneur running a business under the name BabyBlanca Jolanta Babiś entered into the Central Register and Information on Economic Activity kept by the minister responsible for economy and keeping the Central Register and Information on Economic Activity, Latoszyn 111G, 39-200 Dębica, Nip: 872 212 35 26.

§ 3. Technical requirements

For the proper functioning of the Store and the order fulfillment process, you need:

A device with Internet access

An active e-mail account

A web browser that supports JavaScript and cookies.

§ 4. Shopping in the store

The prices of goods visible in the Store are the total prices for the goods, including VAT.

The Seller points out that the total price of the order consists of the price indicated in the Store: the price for the goods and, if applicable, the costs of delivery of the goods.

The goods selected for purchase should be added to the basket in the Store.

Then, the Buyer selects from the available in the Store: the method of delivery of the goods and the method of payment for the order, and also provides the data necessary to complete the order.

The order is placed upon confirmation of its content and acceptance of the Regulations by the Buyer.

Placing an order is the same as concluding a sales contract between the Buyer and the Seller.

The Seller will provide the Consumer with a confirmation of the conclusion of the sales contract at the latest upon delivery of the goods.

The Buyer may register in the Store, i.e. create an Account in it or make purchases without registration by providing his data with each possible order.

The information on the store's website does not constitute an offer within the meaning of the Civil Code. The buyer who places an order for a specific product submits a purchase offer under the conditions specified in the product description, but pays the payment with a delayed payment date.

If the stock of the product ordered by the buyer is exhausted, the buyer is informed by e-mail or telephone within 2 working days. in such a situation, the customer may cancel the entire order or its part.

§ 5. Payments

You can pay for the order placed, depending on the Buyer's choice:

By ordinary transfer to the Seller's bank account.

Cash on delivery, i.e. cash upon delivery to the Buyer.

If the Buyer selects payment by bank transfer, the order must be paid for within 7 Business Days of placing the order.

Pre-payment of 100% of the value of the ordered goods to the Seller's account is made on the basis of a pro forma invoice sent to the Buyer via e-mail. In this situation, the goods are packed and sent to the Buyer only after the payment is credited to the Seller's account.

The seller informs that in the case of some payment methods, due to their specificity, payment for the order with this method is possible only immediately after placing the order.

By making purchases in the Store, the Buyer accepts the use of electronic invoices by the Seller. The buyer has the right to withdraw his acceptance.

§ 6. Order fulfillment

The seller is obliged to deliver the goods without defects. All products available on the store's website are brand new, free from physical and legal defects and have been legally introduced to the Polish market.

The date and cost of the contract is indicated in the Store, (applies to the territory of Poland, other countries, delivery time up to 10 days)

If the Buyer has chosen to pay in advance for the order, the Seller will proceed with the order after paying for it.

In a situation where, under one order, the Buyer has purchased goods with a different delivery date, the order will be processed on the date appropriate for the goods with the longest deadline.

Goods purchased in the Store are delivered depending on the delivery method chosen by the Buyer:

Via a courier company.

The shipping costs listed on the website apply to shipping in Poland and specific countries. The costs of international shipments, which are not included on the website, are calculated individually, after prior contact with the Seller.

The method of delivery of the goods is chosen by the Buyer at the stage of placing the order. If the Buyer chooses the pallet shipping option, the terms and costs of delivery are determined by e-mail or telephone between the Buyer and the Seller within 2 business days.

In some cases, the Seller may add to the total price of the transaction the cost of pallets, other packaging, or a deposit for returnable packaging. The Buyer will receive such detailed information by e-mail each time before concluding the contract and executing the order.

Confirmation of acceptance of the order for execution by the Seller and return acceptance via e-mail of the costs and terms of delivery by the Buyer mean the conclusion of a sales contract between the Seller and the Buyer.

It is possible for the Buyer to make changes to the order placed no later than the moment the order is processed. The Seller starts processing the order after sending the order confirmation.

The buyer may place orders 24 hours a day, 7 days a week, however, orders placed on weekdays after 1.00 p.m., on Saturdays, Sundays and public holidays are carried out on the next working day. The Seller sends the goods to the Buyer only on business days, i.e. from Monday to Friday.

The deadline for completing the order is 5 to 14 business days from the date of confirmation of the order by the Seller and depends on the type and quantity of the ordered goods, place and method of delivery. In the case of special orders and in special situations, the order fulfillment time may be extended, about which the Buyer will be notified in advance by the Seller.

The buyer is obliged to ensure the collection of the goods within the agreed time, or the unloading of the goods at the place of delivery (unless the parties agree otherwise at the stage of concluding the contract) and safe and free access to the place of delivery.

In the absence of the Buyer at the place of delivery, at the agreed time, the presence of a person authorized to collect the goods on behalf of the Buyer is required.

If the goods are delivered within the time agreed by the parties and to the address indicated by the Buyer in the order form, and if the goods are not picked up or the goods are not unloaded for reasons attributable to the Buyer, the cost of returning the goods or re-shipping is charged to the Buyer.

After receiving the parcel, the buyer checks the condition of the parcel and its compliance with the order. In the event of damage to the shipment or non-compliance with the order, it is necessary to draw up a protocol in the presence of the person delivering the goods, and then inform the Seller about the situation as soon as possible.

In the event of justified doubts regarding the order placed by the Buyer, the Seller reserves the right to additional verification of the order by telephone or e-mail contact with the Buyer.

In the case of the Buyer who is a legal person or an organizational unit without legal personality, all activities related to the use of the store are performed only by a person authorized to exercise all rights and obligations on behalf of and for this entity.

§ 7. The right to withdraw from the contract

Pursuant to art. 38 point 3 of the Consumer Rights Act of May 30, 2014, i.e. of January 28, 2020 (Journal of Laws of 2020, item 287), the buyer (consumer) is not entitled to withdraw from a distance contract via the website www.babyblanca.pl, because the subject of the services are products manufactured to the Customer's individual order (non-prefabricated items, manufactured according to the consumer's specifications).

§ 8. Complaints

In the event of a defect in the goods, the Buyer has the option of complaining about the defective goods on the basis of the warranty or guarantee provided for in the Civil Code, provided that the guarantee has been granted.

Using the warranty, the Buyer may, on the terms and within the time limits specified in the Civil Code:

Submit a price reduction statement

In the case of a significant defect - submit a statement of withdrawal from the contract

Demand that the item be replaced with a non-defective one

Demand that the defect be removed

The seller asks you to submit a complaint containing a detailed description of the defect of the goods on the basis of the warranty to the postal or electronic address indicated in § 2 of the Regulations.

If it turns out that in order to consider the complaint, it is necessary to deliver the advertised goods to the Seller, the Buyer is obliged to deliver the goods, in the case of the Consumer at the Seller's expense, to the address: ul. Skowronków 1 E, 39-200 Dębica.

If an additional warranty has been granted for the product, information about it, as well as about its conditions, is available in the product description in the Store.

The warranty does not cover products used contrary to the instructions for use or construction practice.

Complaints regarding the operation of the Store should be sent to the e-mail address indicated in § 2 of the Regulations.

Consideration of the complaint by the Seller will take place within 14 days.

EXTRAJUDICIAL METHODS OF SETTLING COMPLAINTS AND PURSUING CLAIMS

In the event that the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, inter alia, with:

§ 9. Personal data

The administrator of personal data provided by the Buyer when using the Store is the Seller.

The Buyer's personal data is processed on the basis of a contract and for its implementation, in accordance with the principles set out in the general regulation of the European Parliament and of the Council (EU) on data protection (GDPR). Detailed information on data processing by the Seller is included in the privacy policy posted in the Store.

§ 10. Reservations

The Buyer is forbidden to provide illegal content.

Each order placed in the Store constitutes a separate sales contract and requires separate acceptance of the regulations. The contract is concluded on time and for the purpose of order fulfillment.

Agreements concluded on the basis of these regulations are concluded in Polish.

Nothing in these regulations excludes or in any way limits the consumer's rights under the law.

§ 11. Provisions concerning buyers who are not consumers

The right to withdraw from a distance contract is not available to an entity other than the Consumer.

Any liability of the Seller towards the Buyer who is not a Consumer is excluded.

In the event of a possible dispute with a Buyer who is not a Consumer, the competent court will be the court competent for the seat of the Seller.

§ 4. Account

Creating an Account is completely voluntary and depends on the will of the Buyer.

The account gives the Buyer additional options, such as: viewing the history of orders placed by the Buyer in the Store, checking the status of the order or editing the Buyer's data.

In order to create an Account, you must complete the appropriate form in the Store.

At the time of creating the Account, an agreement is concluded for an indefinite period between the Buyer and the Seller regarding the maintenance of the Account on the terms specified in the Regulations.

The Buyer may cancel the Account at any time without incurring any costs.

The login and password set by the Buyer are confidential. The buyer is obliged to keep his login and password secret, and to protect them against access by third parties.

Updating the Buyer's data provided during account registration is possible with the use of the login and password. It is the Buyer's responsibility to check and update their data each time before placing the order.

In order to cancel the Account, please send your resignation to the Seller at the following e-mail address: babyblanca@op.pl, which will result in immediate deletion of the Account and termination of the Account maintenance contract.

§ 5. Complaints

Complaints regarding the functioning of the Account should be sent to the e-mail address babyblanca@op.pl.

Consideration of the complaint by the Seller will take place within 14 days.

§ 7. Reservations

In the event of important reasons, referred to in paragraph. 4, the Seller has the right to amend these Account Regulations.

Important reasons, referred to in paragraph. 3 are:

the need to adapt the Store to the legal provisions applicable to the Store's operations

improving the security of the service provided

changing the functionality of the Account that requires modification of the Account regulations.

The buyer will be informed about the planned change to the Account regulations at least 7 days before the change is implemented via an e-mail sent to the address assigned to the Account.

If the Buyer does not accept the planned change, he should inform the Seller about it by sending an appropriate message to the Seller's e-mail address babyblanca@op.pl, which will result in the termination of the Account maintenance agreement upon the entry into force of the planned change or earlier. if the Buyer makes such a request.

If the Buyer does not object to the planned change until its entry into force, it is assumed that he accepts it, which does not constitute any obstacle to termination of the contract in the future.

In the event of a possible dispute with a Buyer who is not a Consumer, the competent court will be the court competent for the seat of the Seller.

Nothing in these regulations excludes or in any way limits the consumer's rights under the law.
